New Mexico is not an eviction moratorium state, it needs to stop claiming otherwise. For evidence of this fact, see this court record: T-4-CV-2021000921. On 2/18/2021 a Writ of Restitution (eviction) was issued against me with an instruction that the Plaintiff, who is represented by Ron Tucker, is required to serve me, I was never served. No reason was or has ever been provided as to why I was evicted. I only discovered that I was, in fact, evicted, by searching the case record online and going into the courthouse myself to pick-up a copy. All three Writs of Restitution filed against me by the same party took place during the Federal Moratorium, and, to date, I have received nothing but additional problems for my obvious troubles. The Plaintiff previously had a Writ of Restitution dismissed after filing for non-payment of rent which I proved was false and malicious. 

FALSE LIST OF STATES COMPLYING WITH THE EVICTION BAN

To add further insult to injury I have now been repeatedly discriminated against in Albuquerque, NM housing while simply trying to find another home for my child and I solely based on the above. Today,  in fact, after applying at the Q in Uptown for a vacant unit to which I was the first to apply, I was told in a telephone conversation verbatim, “We refuse to go forward with your application due to the ongoing Writ of Restitution matter.” I asked her kindly to send this to me in writing as I did not believe this to be a legal justification to deny someone tenancy and she refused to do so.

This is now the second place I have applied to in New Mexico and boldly been denied equal housing due to the ongoing landlord harassment and discrimination I have endured at the Sawmill Lofts. My message to New Mexico is; don’t falsely claim that you are complying with Federal regulations to ban evictions until the end of the moratorium (possibly June 30th, 2021) when you are clearly and obviously not in compliance with the order and have not been since its issuance.

Living here is truly hell, if you are trapped here, like me, I feel truly sorry for you. If you have not made the mistake of moving here but are thinking about it, don’t. I would rather live in a State who is boldly not complying with the moratorium because at least you know what you are dealing with. To be in a fake “liberal” State where the majority of people falsely believe they are protected from institutional corruption when they are obviously not, is much, much worse.
